Introduction

This Privacy Policy applies to the collection, use and storage of personal information by Smart Catalog Pty Ltd (ACN 167 363 153) (Smart Catalog, we, us, SC), including information collected via the Smart Catalog mobile device application known as OCMP (mobile app & web platform). By using the App or the web platform, you consent to Smart Catalog collecting, using and storing any information that you supply. If you do not agree to the terms in this Privacy Policy, you must immediately stop using the app and platform and remove/uninstall it from your device.

End User Data

Smart Catalog provides OCMP as a cloud based services to Starta/Owners corporations, contractors and other businesses (ie. Starta/OC manager, Security company or any other service provider) to manage the facility booking, compliance management, contractor’s work log management etc. Through the provision of these services, we may collect personal information about individuals who are tenants or lot owners or staff of contractors/providers (End User Data). Our collection, use and sharing of End User Data is governed by applicable laws. If you are using the Platform through a Provider that is a customer of Smart Catalog, this Privacy Policy does not supersede the terms of any agreements between Smart Catalog and any other party, nor does it affect the terms of any agreement between any user of the Platform and their Provider. Please read the terms of any privacy policies that you enter into with parties other than Smart Catalog, including your Provider, as those policies may also explain how your personal information is used by those parties.

Collection of Information

When you use the Platform, we may collect: personal information from and/or about you (including your name, email and any personal information comprised in any data you input into the Platform); information relating to your use of the Platform, including (but not limited to) your address, lot details, the times and dates on which you booked any facility and/or use the Platform, the details of any complaint or non compliance issues ie. the photos of a breach or complaint, the Platform features accessed, details of any information or document ie. invoices, meeting minutes etc downloaded from, and uploaded onto, the Platform and information captured by cookies on your device in connection with the collection of the above information, or if you are a service contractor the Mobile app will track your current location to show your work location within the platform.

If you wish to make a complaint in relation to privacy you can raise the complaint at info@smart-catalog.com.au. We will endeavour to respond to complaints within a reasonable period.

Data control and processing

The Information provided to or collected by the platform is controlled and processed by Smart Catalog and, if applicable, your provider/manager. We may transfer your information and process it outside your country of residence, wherever Smart Catalog, its affiliates, service providers and, if applicable, your provider operate. Our operations and those of our affiliates and providers cover many different countries, so it is not practicable to specify those countries to which personal information about you may be transferred in this Privacy Policy.

Security

We have put in place security safeguards designed to protect the personal information that you provide in accordance with industry standards. Information is stored on secure electronic storage systems. Technical and operational measures are used by us to protect the Information against modification, disclosure, access and misuse by unauthorised third parties, (including encryption of all data when it is transferred to our service providers and limitations on access to Information within our business). We regularly monitor our system for possible vulnerabilities and attacks to protect the Information. However, since the Internet is not a secure environment, we cannot ensure or warrant the security of any information that you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please help keep your account safe by using a strong password.

International storage and transfer of data

Smart Catalog and its service providers may, from time to time, locate certain computer databases, which store personal information relating to Smart Catalog’s products and services, in countries outside of Australia. The export of personal information to such countries is permitted subject to the provision of adequate levels of protection in relation to the processing of such information. As a key part of the contractual arrangements between Smart Catalog and third party service providers, such parties are required to maintain appropriate levels of security and confidentiality in respect of personal information. When appropriate, or otherwise required by applicable law, you will be provided with notice of the fact that your personal information may be transferred, stored or processed outside of Australia.

Purpose of collection and use

Information will primarily be collected and used by us so that you may access and use the Platform. The Information may also be used to administer the platform and to improve the standard of the services offered through the platform. In addition, we may collect Information in an aggregated form concerning your usage of the Platform for the purpose of general data analysis (for example, statistics on cross-institutional and/or cross-disciplinary comparisons of the use or popularity of the Platform). We may disclose this aggregated data in a de-identified form to our affiliates and to third parties.

Disclosure

Smart Catalog is committed to protecting your personal information. We will not disclose personal information about you to third parties without your consent except: where you use the platform through a provider, to that provider; to third parties that make a legally-compliant request for the disclosure of personal information, or when we, in our reasonable opinion, believe that disclosure is necessary to protect our rights, or in good faith believe that such action is necessary to comply with Australian laws; to our service providers who assist with managing the Platform; if the assets that we use to operate our business are acquired by a third party, to that party; or if we buy or sell subsidiaries or business units then in such transactions customer information is one of the transferred assets, but would remain subject to the commitments made in any pre-existing Privacy Policy or equivalent. Other than this, we will only disclose Information to an unrelated third party after receiving your consent to such disclosure. We do not sell any of your personal information to third parties for direct marketing purposes.

Accessing Your Information and Opting Out

You can request that personal information we hold about you be provided to you for your review, be removed from our services, or be updated by contacting our Privacy Officer by email at info@smart-catalog.com.au. If you are accessing the Platform through a Provider, you may also be able to make such a request through your provider. In some cases, we may not be able to remove the information or continue to provide services through the platform following its removal, in which case we will let you know if we are unable to do so and why.

Amendments to this Privacy Policy

We reserve the right to update this Privacy Policy at any time, and any such updates will take effect upon publication on the Platform. If we make material changes to this Privacy Policy, we will provide notice through the Platform, or by other means so that you may review the changes before you continue to use the platform. If you object to any changes, you must immediately stop using the Platform and remove it from your device. Continuing to use the Platform after we publish or communicate a notice about any changes to this Privacy Policy means that you are consenting to the changes.
